As a EuroFPL user you...

- Confirm that data provided in conjunction with the filing is for private use

- Agree not to distribute data to any third-parties other than those with a specific need-to-know regarding flight information in support of flight operations (drivers, handlers, family and friends, etc.)

- Acknowledge that all charts and AIP data provided are for pre-flight preparation only, and that copyright of this data remains with the original author, and that no distribution or release of the data to any third-parties is authorized

- Acknowledge that flight plan filing is strictly for the purpose of conducting flight operations, and that spurious flight plan filing and cancellations without intent to conduct flight operations may result in civil and criminal liability from Eurocontrol and the respective national authorities making preparations for spuriously filed flight plans

- Accept that all operations of the EuroFPL website will be done by human interaction with the interface provided, and shall not be automated with macros, scripts, automated data entry programs or applications of any sort. Automated downloading of EuroFPL generated data or "scraping" shall result in immediate service termination with black-listing of all aircraft and pilot associated with the account

- Acknowledge that EuroFPL will collect and retain personal and personally identifiable data necessary to perform flight planning and filing operations

- Accept that all FPLs validated with EuroFPL will automatically have *ONLY* their aircraft type, flight level, and route data added to a public database of validated flight routes available to all users of EuroFPL

- Accept that flight plans, when stored, will have their FPL data transmitted to Eurocontrol for IFPS validation. Route proposal requests will have their invalid FPL data transmitted to Eurocontrol for route proposal querying

- Acknowledge that no personally identifiable data will be transmitted to third-parties in the following third-party user data provisioning:
(a) All functions that incorporate a mapping function will have mapped coordinates and data transmitted to Google for map generation purposes
(b) All nav-log requests will have route and altitude data transmitted to third-parties for the expansion of the airway routes into waypoints and for the retrieval of forecast winds aloft data appropriate to time and altitude of flight

- Acknowledge that with the exception of valid route data and the scenarios listed above, no disclosure of any user data to any third-parties will occur without:
(a) Specific request of the user (FPL filing actions, setup of flight notifications)
(b) A request from a SAR conducting authority in conjunction with a missing or overdue flight
(c) A request from an ANSP (Eurocontrol, NATS, etc.) in conjunction with the provision of air traffic control functions
(d) A request from a local authority (ARO, airport authority, etc.) in conjunction with the provision of air traffic control and charging functions
(e) A request of purchaser data from a national VAT authority in conjunction with the request of information necessary to show EuroFPL compliance with VAT regulations relating to the provision of electronic services

- Accept that employees of EuroFPL will have access to all data stored in the EuroFPL system only to the extent necessary for job functions and no data shall be stored on any computing device other than EuroFPL servers or backup media

- Accept that data of EuroFPL user accounts, including accounts that have been deleted by the user or EuroFPL, may be retained for up to five (5) years

- Accept that user data will be used by EuroFPL in direct operational support of user requested functions during access to the EuroFPL site. Flight plan data may be used internally EuroFPL to display advertising images to the user embedded on EuroFPL pages

- Acknowledge that EuroFPL is a communications conduit and that all responsibility for compliance with ICAO SARPS, local regulations, regulations that apply to the flight operations conducted lies strictly with the AO and PIC of the flight

- Acknowledge that EuroFPL is a communications conduit and that distribution of the flight plans and acceptance by the receiver of these flight plans is subject to interruption from acts of god, internet service disruptions, third-party communications service provider disruptions, and that no liability to EuroFPL for the performance or lack thereof of the flight plan filing system shall be assigned

- Acknowledge that weather briefing, NOTAMS, AIP/PAMS data, aircraft performance, and winds aloft data provided to pilots are provided in good faith, but without warrant of accuracy or completeness, and are advisory only and that the PIC and AO are solely responsible for the safe conduct of any flight irrespective of any data received from EuroFPL or use thereof

- Acknowledge that in-flight diversion to another destination may render the flight tracking and flight notification service inoperative for the remainder of the flight

- Accept that DLA messages sent by third-parties (tower, handlers, etc) may or may not disable the transmission of further DLA/ARR/CNL messages from EuroFPL, and that no EuroFPL FPL messaging function can be assured if the flight plan has been modified by a third-party after filing

- Acknowledge that the pilot will not use the AD addressing function of the EuroFPL filing system to send the flight plan to any party that does not have an operational need to receive a copy of the flight plan message

- Acknowledge that the data provided in the personal section of the EuroFPL system is the true and correct name, date of birth, permanent address, pilot license numbers, and authority of license issuance and that any inaccuracy in this data is grounds for termination of service and permanent removal from access to the EuroFPL system

- Accept that the pilot will provide their mobile phone number or appropriate ground dispatch contact number in their pilot profile for the inclusion in their flight plan for ATS contact purposes

- Accept that the pilot will provide, for flight operations in Canada, SAR contact information in their pilot profile for inclusion in their flight plan for SAR contact purposes

- Acknowledge that the pilot will provide only truthful, accurate, and complete flight plan data and that liability for any inaccurate flight plan data submission provided to EuroFPL shall be borne completely by the pilot. Intentional inaccurate flight plan submission is grounds for permanent removal from access to the EuroFPL system

- Acknowledge that the pilot, before conducting any flight with the assumption that EuroFPL has transmitted any flight plan, shall verify that the flight plan has been received by the local authority, through any of the following methods:
(a) Receipt of a VFR or IFR clearance from ATC or their ground representatives at the aerodrome of departure
(b) An ACK message relayed from EuroFPL
(c) The confirmation of a flight plan on file from any third-party flight tracking resource
(d) A telephonic verification with the ARO/ATS unit with jurisdiction of the flight departure point
(e) Any other method acceptable to the PIC that will verify that a filed flight plan has been received by appropriate ATS unit(s)

- Accept that the pilot in command is the final authority for the safe operation and conduct of any flight and that EuroFPL as a communications conduit, in no way accepts or transfers any responsibility for the conduct or safety of any flight operation to EuroFPL, Kenmore Crew Leasing, Inc, or employees of EuroFPL

- Acknowledge that you will secure the account details (username and password) and accept full responsibility for the actions of any person logged in under your EuroFPL account, including civil and criminal liability for unauthorized distribution of copyright or license protected data received from the EuroFPL system

- Acknowledge that you will maintain no more than one (1) EuroFPL account for your use, and in the event that you establish a second replacement account, will immediately notify support@eurofpl.eu so that the first account can be removed. The maintaining of more than one EuroFPL account at the same time will result in disabling and deletion of all user associated EuroFPL accounts without refund

- Accept that you will hold harmless EuroFPL, Kenmore Crew Leasing, Inc. and employees and vendors of the same from any liability or civil action resulting from use of EuroFPL

- Acknowledge that the location of service provisioning is Bellingham, Washington, United States, and that in the event of any disputes, the laws of Washington State and the United States of America will apply. You also accept that the agreed venue for the hearing of any disputes is Whatcom County Superior Court, Bellingham, Washington, United States

- Acknowledge that the agreement accepted is a full and complete agreement between you and EuroFPL and that no change or modification to this agreement shall be made without a written addendum bearing the original signature of an officer of Kenmore Crew Leasing, Inc. and yourself

- Acknowledge that pilots and aircraft found to be associated with abuse the EuroFPL system may be blacklisted and prohibited from use of EuroFPL and filing of any flight plans

- Agree that you may terminate service at any time but will not be entitled to refund of any amounts paid prior to termination

- Accept that EuroFPL may terminate service at any time for breach of agreed terms in this document or abuse of EuroFPL system and you will not be entitiled to refund

- Acknowledge that EuroFPL may terminate service at any time for any reason, including inability to provide the service, and that liability will be limited to refund of pro-rata unused service period amounts paid

- Acknowledge that EuroFPL does not guarantee flight tracking and notifications provisioning or performance and that failure to provision or deliver these two services shall not be grounds for refunds or service cancellation
